CASE STUDY :
 
Question : Good morning.  When A buys a property and says A married to, does B need to sign the DOAS ? Thanks for advise
Answer : A has to prove where he got the money to buy. Did he get the money thru inheritance/ gratuitous means? If not, by default, property is presumed conjugal & B's consent is needed.
Question :  Spouses A and B are abroad and gave SPA to a relative to purchase a property here. But the SPA was signed only by A.  Will that SPA be honored by BIR and RD ?
Answer:  Apparently, spouses A & B want to acquire their common property. Though BIR & RD may accept the SPA; yet, it would be best that both will sign SPA so title will surely be issued both in their names as spouse
Question : But is It ok to have new title named to A married to B?  
Instead of Sps A and B? 
Any of the above would be conjugal acquisition po ba? Because that is what A wants to put in documents   (married to B) to make the problem easy to solve.  But am in no position to say this is right.
Answer : Under our present laws, there’s no difference between A married to B or Spouses A & B. Still conjugal.
