IMPORTANT ADVISORY ON NOTARY PUBLIC

IMPORTANT ADVISORY :

Recently an associate asked me about an issue regarding Notary Public validity.  The concern was can a Deed of Absolute Sale located in a certain municipality be notarized in a different location.

For example, can a Deed of Sale of a property located in Manila be notarized in Quezon City ?  That is not the issue.

Take note that in a Deed of Absolute Sale, it specifically says that the sale was signed in a certain municipality. 

Upon research and confirmation with several Notary Public, this law was actually was passed way back in 2004, however, implementation was not put into effect. 

We all are aware how so many laws are drafted, signed and is already a bill, however, it’s always IMPLEMENTATION of the law that’s the issue.   It’s good that existing laws are now actually being implemented ( there are still that aren’t in effect though ).

So for this particular case regarding Deed of Absolute Sale, please be guided accordingly.  The Notary Public will only be valid on the same municipality where the Deed of Absolute Sale was specifically signed regardless of the location of the property.
