CASE STUDY :

Question?

Isn’t it that if a person is married ( ex husband ) and the title will be put in the following name: “( husband ), married to ( wife )”. There is no necessity for the wife to sign the DOAS?

It is in selling that it is critical that both sign with wife indicating marital conformity?

Can you provide your thoughts on this ?

Secondly, if we go to the PSA ( NSO ) and in their record the person buying is reflected as single and is able to secure a CENOMAR ( Cert of No Marriage ), isn’t it that technically the marriage abroad can be viewed as non-existent in the Philippines?

Answer :

You’re correct that in selling, wife’s signature matters. But people you deal with also matters such that if Register of Deed requires wife to sign, suggest you just comply to avoid going back & forth to your client/s.

As to CENOMAR, you can’t simply say you’re single because CENOMAR says so if in truth & in fact, you’re actually married abroad. Just remember that if you sign the DOAS as single, though you’re actually married, you’re doing that under OATH & that renders you liable for falsification/ perjury.
