Case Study : On ownership of property, what's the difference between having the Title names as follows :

1) Spouses R & B

2) R married to A ?

Do both spouses have to sign Deed of Absolute Sale ? How does the 1988 family code affect sale of properties amongst spouses ?

Answer : In current practice, there is no difference. Both are required to sign unless you can prove that subject property is wife’s paraphernal or husband’s capital.

If you mean sale of property between spouses, the family code is irrelevant & has no impact because such sale is prohibited even before & after 1988 for reason that it’s contrary to law, morals & public policy.
